Terms of Service

These Terms of Service ("Terms") govern your access to and use of Radian, including the website at getradian.dev, the macOS and iOS applications, and any related services (collectively, the "Service").

The Service is operated by Andrei Motin, an individual based in the United States ("we," "us," "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Beta status

The Service is currently in beta. This means:

  • Features may be incomplete, change without notice, or be removed.
  • The Service may be unavailable, slow, or behave unexpectedly.
  • Data may be lost (we will not knowingly delete your data, but we make no guarantee).
  • The Service is provided free of charge during beta. Pricing will be announced before any paid tier launches, and you will not be charged without explicit consent.

You acknowledge and accept these risks when using the Service in beta.

2. What the Service does

Radian is a personal on-call agent for developers running their own infrastructure. It watches your Mac (Docker containers, processes, system resources), proposes fixes when something breaks, and executes those fixes only when you explicitly approve them from your iPhone.

You retain full control over what runs on your machine. Radian will never execute a command without your explicit per-action approval.

3. Account and access

During beta, "access" means signing up via our beta form and receiving installation links. We may grant or deny access at our discretion.

You agree to provide accurate information when applying. You are responsible for any activity associated with your installation.

4. Acceptable use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any applicable law.
  • Reverse engineer, decompile, or attempt to extract source code from the Service, except where permitted by law.
  • Resell, sublicense, or redistribute the Service without our written permission.
  • Interfere with or disrupt the Service, our infrastructure, or other users.
  • Use the Service to attack, monitor, or harm systems or persons you are not authorized to interact with.
  • Attempt to bypass beta access controls (rate limits, kill switches, device gating).

5. Your data and your machine

Radian runs on your machine. The data it processes — your container logs, process state, system resources — stays on your machine except when sent to a Large Language Model (LLM) provider for diagnosis.

By default, LLM calls flow through our managed proxy infrastructure, which forwards them to the underlying model provider. The proxy applies rate limits and beta gating and logs each call's metadata (your device identifier, model name, timestamp) for abuse prevention. Underlying model providers may change over time; the proxy abstracts away that choice.

You retain all rights to your own data, configurations, and the contents of your machine. You grant us a non-exclusive, limited license to process your data only as necessary to provide the Service.

Sensitive data (credentials, secrets, personal information) may be present in logs we forward to the LLM. You acknowledge this risk. We do not store the contents of your logs beyond the duration necessary for the LLM call and our short-term operational logs.

6. Intellectual property

The Service, including the website, applications, brand assets, and underlying code, is owned by us and protected by copyright, trademark, and other laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.

You may not copy, modify, distribute, sell, or lease any part of the Service except as expressly permitted.

7. Third-party services

The Service depends on third-party providers including Cloudflare (hosting, relay, proxy), Resend (email), and LLM providers (currently DeepSeek). Use of the Service is also subject to those providers' terms and privacy policies. We are not responsible for the availability, performance, or content of third-party services.

8. No warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

We do not warrant that fixes proposed by the Service will be correct or that approving them will not cause harm to your system. You are responsible for evaluating each proposed fix before approval.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, REVENUE, OR BUSINESS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability, so the above may not apply to you.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service, (b) your violation of these Terms, or (c) your violation of any rights of another party.

11. Termination

You may stop using the Service at any time and request deletion of your data by emailing hello@getradian.dev.

We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice. Reasons we may terminate include violation of these Terms, abuse of the Service, or discontinuation of the Service or beta program.

Provisions that by their nature should survive termination (including ownership, disclaimers, limitations of liability, and dispute resolution) will survive.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above and, when significant, by notifying you via email if you've signed up for beta access. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute arising out of or related to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.

If you are a consumer in a jurisdiction with consumer-protection laws that override governing-law clauses, those laws may also apply to you.

14. Miscellaneous

These Terms constitute the entire agreement between you and us regarding the Service and supersede any prior agreements. If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force.

Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign these Terms without our written consent; we may assign them freely (for example, to a successor entity).
